Terms and Conditions

Use of the Site and the products and services offered (referred to collectively as the “Services”), is subject to the following legal terms and conditions (“Terms”), which are effective and binding between you and the Entrepreneurship Foundation, Inc. (“EF”).

This website is provided by EF’s third party service provider, Sponsorcraft Ltd (creator of Hubbub.net), which has no contractual relationship with you, except in relation to any third party rights which Sponsorcraft Ltd may enforce under this contract. Your attention is drawn to the paragraphs entitled “Fund-raising” and “Payments and fees.”

  • “Creator” means any registered user involved in a Project.
  • “Project” means any Project approved by a participating organization and posted on the Site.
  • “Sponsor” means any entity or individual contributing financially to a Project.
  • “Content” means any content, including (but not limited to) videos, audio clips, text, software, pictures and other features and information uploaded to the Site in accordance with the Terms.
  • “Site” means https:// EF.hubbub.net.
  • “Affiliate” means any NGO, college, university, business incubator, accelerator, or an association or other affinity group licensed and authorized by EF to offer the Crowdfunding Services to its members.
  • “Administrator” means the individual authorized by an Affiliate to act as its representative to EF and to curate the Affiliate’s pages on the Site.

By using the Site, you (Affiliate, Administrator, Creator, Sponsor, or other user of the Site) confirm that you accept the Terms and that you agree to comply with them.

Affiliates and their Administrator(s) shall have the right to a unique page and subdomain (e.g. – http://EF.Hubbub.net/Oxford) where all Projects sanctioned by the Affiliate will be posted. Affiliates and Administrators may add their own filters and eligibility criteria for Creators and Projects, and shall enjoy the same rights as EF to reject, edit or remove Projects from the pages it curates.

The Services are available only to individuals who are at least 18 years old. You represent and warrant that you are of legal age to form a binding contract, and that all registration information you submit is truthful and correct.

EF reserves the right to a) refuse the Services to anyone at any time without notice and for any reason; and (b) change its eligibility criteria at any time without notice and for any reason.

You agree to use the Site and all Services responsibly and legally. Under the Terms you are prohibited from taking any action in relation to your use of the Services which:

  • infringes any patent, trade mark, copyright, or right of any other person or entity;
  • is false, misleading or inaccurate;
  • is obscene, offensive, or unlawful in any way;
  • results in software viruses, worms or other material which is malicious or technologically harmful.

You are responsible for configuring your information technology, computer programmes and platform in order to access the Site. You are responsible for using virus protection software.

In order to use parts of the Services, you are required to register and select a password and “User name”.

EF shall not be liable for your interactions with any organizations, Sponsors or individuals. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties or representations associated with listings on the Site.

EF does not exercise control over the timings or performance of Projects in any way; does not warrant that Sponsors’ pledges will be used for any particular purpose; and is not responsible for any misuse of Sponsors’ pledges.

EF is not responsible for any damage or loss incurred as a result of any such dealings in relation to the Projects or otherwise.

EF is under no obligation to become involved in disputes among Sponsors, Creators and Administrators, or any third party. In the event of a dispute, you agree not to pursue EF, its officers, employees, agents, Sponsorcraft Ltd or successors in relation to any claims arising out of or related to such disputes and agree that EF, its officers, employees, agents, Sponsorcraft Ltd and successors are exempt from and not subject to such claims.

Creators are solely responsible for fulfilling obligations both implied and stated in any Project they create. EF reserves the right to remove a Project from the Services and cancel all associated Sponsors' pledges at any time for any reason. Creators may initiate refunds at their own discretion. Neither EF nor Sponsorcraft Ltd is responsible for issuing refunds for funds that have been collected by Creators.

PAYMENTS AND FEES. All funds are collected for Creators via PayPal. Neither EF nor Sponsorcraft Ltd is responsible for the performance or fairness of PayPal. Given the occasional failures of some credit cards, neither EF nor Sponsorcraft Ltd can guarantee the full receipt of the funds raised.

EF will transfer to Creators sponsorship monies collected, less a processing fee of 6% + $.30 per transaction, in a timely manner following the conclusion of the fundraising period.

Affiliates may elect to have all net Sponsor proceeds remitted to the Affiliate entity, for redistribution to individual Creators. A possible reason for doing this may be that the Affiliate requires a Creator to meet additional criteria, such as opening a commercial bank account or establishing an LLC or other legal entity. If an Affiliate chooses to distribute Sponsor proceeds to Creators, this should be clearly indicated on the Affiliate’s own website and curated page of the EF.Hubbub.net page, along with the supplemental accomplishments that must be met (to satisfaction of Administrator) for funds to be released to a Creator.

In the event that EF, PayPal, the participating organization, or any other relevant entity such as a court of law deems that a chargeback is necessary, the Creator assumes the responsibility for all fees and chargebacks as appropriate and will deal directly with PayPal in such cases as required to ensure the issue is resolved.

You agree that EF, in performing the required technical steps to provide the Services to our users, may make such changes to your Content as are necessary to conform and adapt that Content to the technical requirements of connecting networks, devices, services or media.
